These Terms of Service (“Terms”) govern your access to and use of PSV Scripts Viral Mailer Exchange at https://mailer.perseverance-te.com (the “Site”), operated by Garry Ridlington (“we”, “us”, “our”).

By registering for an account, logging in, or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. About the service

Viral Mailer Exchange is an online membership platform where members:

  • Read promotional mail in an on-site web inbox and may earn credits for verified reads;
  • Spend credits to compose and send mail to other subscribed members;
  • Promote websites, banners, and text ads using credits;
  • Participate in referral, affiliate, store, wallet, and membership features made available on the Site.

We may add, change, suspend, or remove features at any time. We do not guarantee any particular level of traffic, clicks, signups, sales, or income.

2. Eligibility

  • You must be at least 18 years old (or the age of majority in your country, whichever is higher).
  • You must provide accurate registration information and keep it up to date.
  • You may maintain one account per person unless we give written permission otherwise.
  • You must not register on behalf of another person without authority, or use false or misleading details.

3. Your account

You are responsible for keeping your password confidential and for all activity under your account. Notify us promptly if you suspect unauthorised access.

We may require email verification before you can use mailer features. We may also offer optional security features such as two-factor authentication.

We may suspend or terminate accounts that breach these Terms, appear fraudulent, or pose a risk to the Site or other members. Where possible we will state a reason; serious abuse may result in immediate termination without notice.

4. Credits

Credits are the Site’s internal unit used to send mail, run ads, and access certain features. Unless we expressly state otherwise in writing:

  • Credits have no cash value and are not legal tender;
  • Credits are non-transferable between members;
  • Credits may expire, be adjusted, or be removed if earned through error, abuse, or chargeback;
  • Credit balances, earning rates, and costs per action may change at any time.

Where the Site offers wallet balances, commissions, or withdrawals, separate rules shown at checkout or in your member area apply. Withdrawals may be subject to minimum amounts, identity checks, and admin approval.

5. Mailer — reading and sending

5.1 Reading mail

Members read mail inside the Site’s inbox. A read may only count toward credits after any read timer or confirmation step completes. Attempts to automate reads, bypass timers, or manipulate credit awards are prohibited.

5.2 Sending mail

When you compose mail, you may only send to members who are subscribed to receive mail on the Site. Credits are typically held when you send and charged when a recipient completes a valid on-site read. Unused held credits may be returned according to the rules shown at send time.

Your membership tier may limit daily sends, recipients per send, cooldown periods, or other mailer settings.

5.3 List membership

Members may manage mail preferences, including unsubscribing from the list. If you unsubscribe, you may be unable to send mail until you resubscribe.

5.4 Email notifications

We may send transactional emails (verification, password reset, purchase receipts, inactivity notices, and similar). We may send short email summaries when you have unread on-site mail. We do not dump full campaign content to external inboxes by default. You agree not to use the mailer to harvest addresses for off-site spam.

6. Advertising and promotional content

Members may submit website, banner, and text ads subject to available credits and tier limits. All ads and mail content must:

  • Be lawful and truthful;
  • Match the destination URL shown;
  • Not promote illegal products, malware, phishing, hate, harassment, adult content where prohibited, or deceptive schemes;
  • Comply with applicable advertising and consumer laws.

Ads may be scanned, queued, or require admin approval. We may reject, pause, or remove any ad or mail without refund of credits where rules are broken. Members may report ads they believe violate these Terms.

7. Referrals and affiliate tools

If you use referral links, splash pages, SuperSplash, banners, or other affiliate tools:

  • You must promote the Site honestly and in compliance with applicable laws and third-party platform rules;
  • You must not use spam, misleading claims, cookie stuffing, incentivised signups without disclosure, or fake traffic;
  • Referral tracking and commissions are recorded by our systems; our records are final except for clear error;
  • We may change commission rates, tiers, or referral rules with reasonable notice where practicable.

8. Store, payments, and subscriptions

The Site may sell membership upgrades, credit packs, spotlights, and other digital products through a store. Prices and what each product includes are shown at checkout.

Payments may be processed by third parties (for example card or cryptocurrency payment providers). By paying, you also agree to their terms where applicable.

Unless required by law or stated at purchase, digital products and used credits are non-refundable. Chargebacks made in bad faith may result in account suspension and reversal of credits or commissions.

Recurring subscriptions, where offered, renew until cancelled according to the instructions shown at purchase.

9. Acceptable use

You must not:

  • Use bots, scripts, or emulators to fake reads, clicks, signups, or traffic;
  • Create multiple accounts to abuse bonuses, referrals, or contests;
  • Attempt to hack, probe, or disrupt the Site or other members’ accounts;
  • Upload or link to infringing, defamatory, or unlawful material;
  • Harass staff or members, or impersonate another person or business;
  • Resell or commercially exploit access to the Site without our permission.

10. Intellectual property

The Site software, design, branding, and admin-provided templates remain our property or our licensors’ property. You retain rights to content you submit, but you grant us a licence to host, display, deliver, and process that content solely to operate the Site.

11. Disclaimers

The Site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

Members are solely responsible for their own ads, mail, websites, and business results. We are not responsible for third-party sites you visit through member promotions.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising from your use of the Site.

Our total liability for any claim relating to the Site is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50, except where law does not allow such a limit.

13. Indemnity

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your content, your advertising, your breach of these Terms, or your violation of any law or third-party rights.

14. Account inactivity and termination

We may warn you by email if your account is inactive for an extended period and may delete inactive accounts after the period shown in our policies or emails. You may delete your account from your profile where that option is available, subject to settling outstanding balances and legal retention needs.

We may terminate or restrict access immediately for serious breaches. On termination, unused credits and digital benefits may be forfeited unless we are required by law to provide a refund.

15. Changes

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Material changes may be notified by email or a notice on the Site. Continued use after changes take effect means you accept the updated Terms. If you are registering, you must read and accept the current version shown during signup.

16. Governing law

These Terms are governed by the laws of [England and Wales / your country or state], without regard to conflict-of-law rules. Courts in [your city/country] have exclusive jurisdiction, unless mandatory consumer protection laws in your country require otherwise.
